Introduction

Blair Health Inc. (“Blair Health,” “we,” or “us”) operates the website www.blairhealth.ca and related mobile applications (collectively, the “Platform”). Your use of the Platform, including its content, telehealth services, subscription programs, pharmacy integrations, laboratory integrations, and educational materials, is governed by these Terms of Service (“Agreement”).

Scope of Services

Blair Health provides access to virtual health consultations, assessments, and treatment programs, primarily related to women’s midlife health, including menopause, weight management, and mental health. Certain services involve interactions with licensed healthcare providers (“Providers”) who deliver clinical care via affiliated medical groups or professional corporations (“Medical Groups”). Blair Health also offers informational content and tools for educational purposes; such content does not constitute medical advice.

Relationship with Providers

Blair Health contracts with independent, licensed healthcare professionals and medical entities (“Medical Groups”) to provide telehealth and consultation services. These Providers are not employees or agents of Blair Health. Blair Health does not interfere with clinical judgment or the practice of medicine. By accepting these Terms, you understand that your medical care relationship is with the Provider or Medical Group, not with Blair Health itself.

Financial Responsibility

Some Blair Health services are covered by private insurance or employer programs; others are billed directly to you on a self-pay basis. Blair Health will disclose all costs prior to booking. You are responsible for ensuring accuracy of billing details, coverage information, and any out-of-pocket payments.

Subscription Services

Certain Blair Health services and programs operate on a recurring subscription basis. Subscriptions will renew automatically unless cancelled in accordance with our policy. Notifications are sent before renewal, and cancellations take effect at the end of the current billing cycle.

Eligibility and Jurisdiction

The Platform is available to residents of Canada who are at least the age of majority in their province or territory of residence. By using the Platform, you represent and warrant that you are physically located within a province or territory of Canada where Blair Health operates at the time of consultation. Services are provided in compliance with applicable provincial health regulations.

Consent to Telehealth

Telehealth involves electronic communications between you and a healthcare provider. These services may not be appropriate for all health concerns. By using Blair Health, you consent to receive healthcare services via telemedicine, acknowledging potential benefits, limitations, and privacy risks as disclosed in our consent form.

Privacy and Data Protection

Blair Health is committed to protecting your personal information in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws, such as Ontario’s Personal Health Information Protection Act (PHIPA). Our Privacy Policy outlines how we collect, use, store, and disclose your personal and health information.

Protected Health Information

Health information collected through the Platform is stored securely in accordance with Canadian privacy laws. Blair Health acts as a health information custodian where applicable and may also act as an agent on behalf of licensed Providers. Only authorized individuals may access your records for treatment, payment, or healthcare operations.

User Responsibilities

You agree to provide accurate, complete, and current information when using Blair Health, including during health assessments and consultations. You are responsible for maintaining the confidentiality of your login credentials and for any activity under your account.

Account Registration and Security

To use Blair Health services, you must create an account. You agree to maintain the confidentiality of your account credentials and notify Blair Health of any unauthorized access. Blair Health is not liable for unauthorized account use or access resulting from user negligence.

Prohibited Uses

You agree not to misuse the Platform, including by transmitting harmful software, impersonating others, or engaging in fraud. You must not interfere with the Platform’s operation, security, or data integrity.

Third-Party Services

Blair Health may integrate with third-party pharmacies, labs, or service providers. Blair Health is not responsible for the actions, omissions, or performance of third parties. Disputes regarding third-party products or services must be resolved directly with the applicable provider.

Intellectual Property

All trademarks, logos, and content on the Platform are the property of Blair Health or its licensors. You may not copy, distribute, or create derivative works without prior written consent.

Fees, Billing and Taxes

Fees for services are displayed prior to booking or checkout. All charges are in Canadian dollars (CAD) unless otherwise specified. Applicable taxes will be added to your total. Blair Health reserves the right to modify pricing at any time, with notice provided to subscribers where applicable.

Termination of Services

Blair Health may suspend or terminate your access to the Platform at its discretion, including for violation of these Terms or misuse of the service. Termination will not affect obligations incurred prior to the termination date.

Disclaimer

THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN “AS IS” BASIS. BLAIR HEALTH MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLAIR HEALTH IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR SERVICES. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT PAID BY YOU FOR SERVICES IN THE SIX MONTHS PRIOR TO THE CLAIM.

Indemnification

You agree to indemnify and hold harmless Blair Health, its affiliates, Providers, and employees from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes will be subject to the exclusive jurisdiction of the courts of Ontario. You agree to attempt good-faith resolution before resorting to legal action.

Electronic Communications

By using the Platform, you consent to receive communications electronically, including email and SMS. You may withdraw consent by contacting support@blairhealth.ca, though this may limit your use of certain services.
